Agentic AI’s governance challenges under the EU AI Act in 2026
In 2026, the European Union’s (EU) Artificial Intelligence Act (AI Act) will require businesses to be accountable for their use of AI agents. The EU AI Act aims to ensure that AI systems are used responsibly and safely, but when it comes to agentic AI - i.e., AI models that can execute tasks and make decisions on their own - governance becomes a major challenge.
Agentic AI lacks a clear, transparent record of its actions, which makes tracking its activities difficult. IT leaders have to be able to explain exactly what, when, and why an AI agent took the actions it did. However, as AI agents continue to learn over time, this information can become hard to trace and its existence may even be denied.
The EU AI Act, which is set to come into force in 2021, will need to be modified and amended to handle this fast-evolving technology. Otherwise, the Act could prove to be an exercise in futility, unable to police the use of AI right alongside the technology’s rise.
The need to regulate AI agents comes from high-profile incidents involving autonomous systems that have taken unpredicted actions, causing severe damage. Therefore, the EU AI Act is crucial in ensuring transparency, accountability, and safety, even when AI systems are operating autonomously.
However, the challenges that come with agentic AI will need to be addressed, as these systems hold the potential to redefine how businesses function. In the years to follow, as AI technology continues to advance and AI agents become more prominent, IT leaders will need to find solutions to ensure that these systems are being used safely and responsibly.
